土地使用权的抵押,是在国家法律允许将土地这一基本的生产要素作为商品纳入流通领域之后,得以在法律上立足的概念之一。其权利的行使,局限于因出让而取得的土地使用权,其运用通常来源于土地使用者经营土地的需要。由于我国以往“土地不是商品”的观念长期禁锢人们的头脑,因此,以土地使用权作为抵押这一论题的探讨,相应的被列入法律的禁区。而现行的有关法律、法规虽然已确立了土地使用权抵押的法律制度,但对此项权利的行使的具体条件、范围及有关法律问题的规定则不免详尽或不够明确。因此,本文拟就笔者学习领会有关土地使用权抵押法律规定过程中所涉及的几个法律问题浅谈见解。
The mortgage of the right to use land is one of the notions that the law allows the basic production of land as a commodity to be included as a commodity in circulation. The exercise of their rights is limited to the land-use rights obtained through the assignment, and their application usually comes from the needs of the land users for the operation of the land. Because China's past “land is not a commodity ” concept of long-term imprisonment of people's minds, so to land use rights as a mortgage discussion of this topic, the corresponding was included in the law restricted area. However, although the existing laws and regulations have established the legal system of mortgage of land use rights, the specific conditions and scope of the exercise of such rights and the relevant legal issues can not but be exhaustive or not clear enough. Therefore, this article intends to talk about several legal issues involved in the process of the author's study and understanding of the mortgage of land use right.
